Gravity Apps ("we," "us," or "our") operates the Discover Near Me mobile application ("the App") and associated services ("the Services").
This policy governs our handling of the collection, use, and disclosure of personal information received from users of the App.
Although we will comply with this Privacy Policy in respect of information provided to us by persons under the age of 18 years, individuals under the age of 18 must obtain parental or guardian consent before using the App, and the parent or guardian will be responsible for supervising their use.
Our guiding principle is to collect only what we need. Here is what that means in practice:
When you sign up, we ask you for your email address to verify your ownership of the email address.
In providing us with any personal information, you warrant that you are authorised to provide us with that personal information and that we are able to use that personal information for the purposes as set out in this privacy policy.
We store the content that you upload or receive or maintain in your app account. This is so you and others can use the App as intended, for example, to create a listing for you and others to browse. We keep this content as long as it is relevant to the functionality of the App and as long as your account is active. We will remove expired content at our discretion.
We may store your searches to help you discover more relevant content and to know where our users are active so we can bolster our listings in popular areas.
You can enable location sharing within the App. This offers more convenient navigation for you and allows us to service you relevant content.
We may collect and store crash logs and performance diagnostics to help improve the stability of the App and improve the user experience.
We may collect and store installation ID to prevent fraud and abuse.
We access or disclose your information to provide products or services you have requested.
We use some third-party subprocessors to help run our App, provide the Services to you and perform business support functions for us.

We may access your publicly user generated content to validate that it is in line with our Terms and Conditions.
We may also access your data if required in order to respond to legal process.
We may have to access other collected data in rare cases, for example, if an error occurs that stops an automated process from working and requires manual intervention to fix or to help us troubleshoot or address a software bug that affects the App. You can submit a bug report from within the App and give us consent for further email correspondence.
We may access your data to investigate, prevent, or take action regarding restricted uses as per our Use Restrictions Policy. Accessing a customer’s account when investigating potential abuse is a measure of last resort. We want to protect the privacy and safety of both our customers and the people reporting issues to us, and we do our best to balance those responsibilities throughout the process. If we discover you are using our App for a restricted purpose, we will take action as necessary, including notifying appropriate authorities where warranted.
We may aggregate and/or de-identify data collected through the services. We may use de-identified or aggregated data for any purpose, including marketing or analytics.
When you use the App, you acknowledge that you may not:
Collect or extract information and/or user data from accounts which do not belong to you.
Circumvent, disable, or otherwise interfere with security-related features of the App.
Trick, defraud, or mislead us or other users, including but not limited to making false reports or impersonating another user.
Upload or transmit (or attempt to upload or to transmit) viruses or any type of malware, or information collection mechanism.
Interfere with, disrupt, or create an undue burden on the App, the Services or the networks or the Services connected.
Harass, annoy, intimidate, or threaten others, or any of our employees engaged in providing any portion of the Services to you.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Accounts found to be in violation of the above are subject to cancellation without prior notice.
Violations can be reported through the App or by email support@gravityapps.com.au and should include detailed information about the account, the content or behavior you are reporting, and how you found it, including URLs or screenshots. We will not disclose your identity to anyone associated with the reported account.
All data is encrypted via SSL/TLS when transmitted between App and our systems. All data when stored is server-side encrypted.
We keep your information for the time necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and your choices, after which, we may delete and/or aggregate it. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. This policy outlines specific retention periods for various types of information.
Our App and supporting infrastructure are primarily hosted in Asia Pacific and in the United States.
Users' personal information is uploaded to, and kept on, the servers that are maintained by third parties that comply with strict privacy obligations.
If you are located in the European Union, UK, or elsewhere outside the United States, please be aware that any information you provide to us will be transferred to and stored in the Asia Pacific or the United States..
By using our App and/or providing us with your personal information, you consent to this transfer.
Deleted content becomes unavailable to other users, and in most cases, it will also be inaccessible to you.
We may retain the deleted content for at most 60 days to investigate restricted uses and in an anonymised form for analytical purposes.
If you choose to cancel your account, your content will become inaccessible and should be purged from our systems in full within 60 days. This applies in both cases when an account owner cancels directly and for auto-canceled accounts.
We will retain your information for as long as your account is active or as necessary to provide App functionality, comply with our legal obligations, resolve issues, address queries and enforce our agreements. If you no longer wish to use our App, you may request that your account be deleted.
You can initiate the deletion of your account from within the App and via weblink.
When you initiate account deletion, we will disable public access to your content.
We may conduct a validation of the content you've generated. In the event of a violation of our terms and conditions, we will disable your account, and preserve all information for legal actions if needed.
If no breaches are found, we will proceed with the permanent deletion of your account and associated user data within 60 days.
This entails:
Delete your account information, including email
Delete all your user generated content, including shared listings and submitted feedback (bugs, requests, etc.)
Anonymise or delete your search history
Delete email correspondence with us
Please note that this Privacy Policy forms part of the Terms and Conditions for use of the App and forms part of the Agreement between you and us. We may, from time to time, amend this Privacy Policy, in whole or part, in our sole discretion.
We may update this policy as needed to comply with relevant regulations and reflect any new practices.
If we make significant changes, we will refresh the date at the top of this page.
However, in any event, by continuing to use the App following any changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Privacy Policy, as it may be amended from time to time, in whole or partly, you must terminate your use of the App.
